JB Marks Local Municipality Cracks Down on Illegal Student Housing

The JB Marks Local Municipality’s Department of Housing Development and Planning has issued a critical Public Awareness Notice regarding student housing and development compliance.

Under the leadership of Cllr. Adrë Lee-Rail Swarts (MMC for Housing Development & Planning), the municipality is taking a firm stand against illegal accommodation facilities operating without the necessary approvals.
If you are a property owner, developer, or operator within the municipality, here is everything you need to know to ensure your facility is lawful and safe.
What Property Owners Must Have
Operating a student accommodation facility without specific municipal approvals is illegal. To be compliant, every development must possess:
Approved Building Plans: Documentation verifying that the structure meets safety and engineering standards.
Correct Zoning: The property must have the appropriate zoning or "consent use" specifically for student housing.
Land Use Rights: Verified legal rights to use the land for commercial residential purposes.
Health and Safety Compliance: Adherence to all local health and safety regulations.
Service Approvals: Official municipal authorization for water, sewer, and electricity connections.
Upcoming Inspections: Starting March
The municipality has announced that serious compliance inspections will begin this March. Property owners and developers should expect formal notices of inspection from the Town Planning Inspector. These notices will be issued based on the information currently available to the municipality.
Important Note: Do not wait for an inspection to begin the regularization process. Compliance with municipal regulations is mandatory for all operators.
