  • Vavi Saak Oorwinning vir Huiseienaars

    Vavi-saak is ’n oorwinning vir gewone huiseienaars wat sukkel met skuld. Beeld: The Go-To Guy Creations Die jongste uitspraak in die hofsaak tussen Standard Bank en vakbondleier, Zwelinzima Vavi, bring nie net lig op die finansiële uitdagings van een van Suid-Afrika se mees sigbare figure nie, maar bied ook hoop en riglyne vir duisende ander huiseienaars wat hulleself in soortgelyke posisies mag bevind. Agterstallige skuld en ’n poging tot geregtigheid Die saak spruit uit agterstallige verbandbetalings op Vavi en sy vrou, Norah, se huis in die luukse buurt Sandton. Op die hoogtepunt het die agterstallige skuld gestaan op bykans R170 000. Sedertdien het die Vavi’s egter gereeld en pligsgetrou begin betaal, en die skuld verminder tot net oor die R85 000 – die waarde van vier maandelikse paaiemente. Ten spyte hiervan het Standard Bank steeds versoek om die huis op eksekusie te plaas, en boonop regskostes van meer as R160 000 geëis. Regter Stuart Wilson het egter ’n belangrike uitspraak gelewer: Die hof het geweier om die eiendom op hierdie stadium op eksekusie te plaas en het elke party beveel om hul eie regskostes te dra. Regter wys op die groter prentjie Regter Wilson het spesifiek uitgelig dat Standard Bank nie voldoende rede verskaf het waarom eksekusie op die huis in hierdie stadium regverdig sou wees nie. Hy het aangedui dat die Vavi’s se volgehoue poging om hul skuld af te betaal wys op goeie trou en dat dit onregverdig sou wees om drastiese stappe te neem in weerwil van hul betalingsgeskiedenis. Die hof het ook aangedui dat, sou Standard Bank in die toekoms beter bewyse kon lewer dat hul aksies proporsioneel is tot die skuld, hulle weer ’n aansoek mag bring. Tot dan, het die hof die aansoek vir eksekusie onbepaald uitgestel. ’n Les en verwysingspunt vir ander huiseienaars Hierdie uitspraak is belangrik – nie omdat dit ’n bekende naam betrek nie, maar omdat dit regsbeginsels bevestig wat ook vir ander huiseienaars geld. Dit wys dat: • Volgehoue pogings om skuld af te betaal wel in ag geneem word. • Regskostes moet redelik wees in verhouding tot die skuld. • Die hof nie outomaties ’n huis sal laat verkoop as daar bewys is van nakoming nie. In ’n tyd waar baie Suid-Afrikaners worstel om kop bo water te hou, bied hierdie uitspraak ’n mate van beskerming en hoop – mits jy bereid is om jou verpligtinge na te kom en gereeld te kommunikeer met jou kredietverskaffer. Slotsom Hoewel hierdie saak sekerlik aandag trek omdat dit ’n publieke figuur soos mnr. Vavi betrek, lê die ware waarde daarvan in die wyser wat dit stel vir gewone mense.
